NSW Strata Renewal & Collective Sale FAQs

Strata renewal is the process under Part 10 of the Strata Schemes Development Act 2015 (NSW) that allows a 75% majority of lot owners in a strata scheme to approve either the collective sale of the entire strata building or a significant collective redevelopment of the scheme.

The strata renewal process applies to nearly all strata schemes in NSW, except those subject to a development contract, governed by the Retirement Villages Act 1999 (NSW), or schemes registered before 30 November 2016 that have not passed a resolution to ‘opt-in’ to the Part 10 process.

The 75% threshold is significant because it replaces the previous requirement for unanimous consent, empowering the majority of lot owners to decide on termination, sale, or redevelopment, preventing a small minority from blocking proposals supported by most owners.

A Strata Renewal Plan is a detailed document prepared by the Strata Renewal Committee that outlines the specifics of the proposed collective sale or redevelopment, including all information required by regulations, and is formally submitted to all lot owners for consideration.

If 75% support is obtained but some owners dissent, the Owners Corporation must apply to the NSW Land and Environment Court for orders to approve and implement the plan, and the Court can make orders to compel dissenting owners to comply.
