Don't Be Forced Into an Unfair Sale
Feeling pressured by a collective sale? The law gives dissenting owners rights, but you need a powerful advocate to enforce them. Without expert help, you risk accepting an unfair offer or losing your voice in court.
Our strata lawyers fight for dissenting owners. We work to protect your home or investment, challenge unfair proposals & demand you receive full & fair compensation for your property.
Don't Let Your Strata Renewal Fail in Court
After securing 75% owner support, your renewal can still be rejected at the final hurdle: the Land & Environment Court. A flawed application means years of effort & money are wasted as the deal collapses.
Our strata litigation lawyers have a proven record of winning in this Court. We build court-ready renewal plans that withstand judicial scrutiny & get the final approval your project needs to succeed.

NSW Strata Renewal & Collective Sale FAQs
What is strata renewal?
Strata renewal is the process under Part 10 of the Strata Schemes Development Act 2015 (NSW) that allows a 75% majority of lot owners in a strata scheme to approve either the collective sale of the entire strata building or a significant collective redevelopment of the scheme.
When does the strata renewal process apply?
The strata renewal process applies to nearly all strata schemes in NSW, except those subject to a development contract, governed by the Retirement Villages Act 1999 (NSW), or schemes registered before 30 November 2016 that have not passed a resolution to ‘opt-in’ to the Part 10 process.
Why is the 75 percent threshold for strata renewal significant?
The 75% threshold is significant because it replaces the previous requirement for unanimous consent, empowering the majority of lot owners to decide on termination, sale, or redevelopment, preventing a small minority from blocking proposals supported by most owners.
What is a Strata Renewal Plan?
A Strata Renewal Plan is a detailed document prepared by the Strata Renewal Committee that outlines the specifics of the proposed collective sale or redevelopment, including all information required by regulations, and is formally submitted to all lot owners for consideration.
What happens if some lot owners do not support the Strata Renewal Plan?
If 75% support is obtained but some owners dissent, the Owners Corporation must apply to the NSW Land and Environment Court for orders to approve and implement the plan, and the Court can make orders to compel dissenting owners to comply.
Can a single lot owner stop a strata renewal collective sale or redevelopment?
No, under the current Part 10 process, a single lot owner cannot stop a strata renewal, collective sale, or redevelopment if at least 75% of lot owners support the Strata Renewal Plan.
What is a collective sale in the context of strata law?
A collective sale is one of the two possible outcomes of the strata renewal process under Part 10, involving the sale of 100% of the lots and common property within a strata scheme, usually to a developer or single buyer, requiring at least 75% owner support.
Do strata schemes registered before November 2016 need to do anything special for strata renewal?
Yes, strata schemes registered before 30 November 2016 must first pass a general resolution by simple majority to formally ‘opt-in’ to the Part 10 strata renewal provisions before initiating a renewal proposal.
Who typically prepares the Strata Renewal Plan?
The Strata Renewal Plan is prepared by a Strata Renewal Committee elected by the Owners Corporation after initial approval of the renewal proposal at a general meeting; this committee manages the development of the detailed plan for collective sale or redevelopment.
