If you die without a Will (intestate), the law dictates how your assets are divided according to a set formula. This may not align with your wishes and can cause significant stress and delays for your loved ones.

While possible, DIY Wills often fail to comply with legal requirements or address complex situations, which can make them invalid or easy to challenge. Professional legal advice ensures your Will is robust and unambiguous.

Your Executor is responsible for administering your estate. You should appoint someone you trust implicitly who is organised and capable of the task, often a spouse, adult child, or a professional like your solicitor.

In your Will, you can appoint a Guardian to care for any children under 18. You can also establish structures like a Testamentary Trust to manage their inheritance until they reach a certain age.

Assets held in joint names and your superannuation are not automatically part of your estate. Specific legal steps, like a Binding Death Benefit Nomination for your super, are needed to direct these assets.

For a Will to be valid in NSW, it must be in writing, signed by you, and witnessed by two adults who are present at the same time and also sign the document. Beneficiaries should not be witnesses.

You should review and update your Will after any major life event, such as a marriage, divorce, the birth of a child, a significant change in your assets, or the death of a beneficiary or Executor.
