What is strata renewal?
Strata renewal is the process under Part 10 of the Strata Schemes Development Act 2015 (NSW) that allows a 75% majority of lot owners in a strata scheme to approve either the collective sale of the entire strata building or a significant collective redevelopment of the scheme.
When does the strata renewal process apply?
The strata renewal process applies to most strata schemes in New South Wales. It does not apply to schemes subject to a development contract, schemes governed by the Retirement Villages Act 1999 (NSW), or schemes registered before 30 November 2016 unless they have passed a resolution to formally opt in to the Part 10 process.
Why is the 75 percent threshold for strata renewal significant?
The 75% threshold is significant because it replaced the former requirement for unanimous consent. This change allows the majority of lot owners to make decisions regarding termination, sale, or redevelopment, preventing a small minority from blocking proposals supported by most owners.
What is a Strata Renewal Plan?
A Strata Renewal Plan is a detailed document prepared by the Strata Renewal Committee that sets out the full details of the proposed collective sale or redevelopment. It includes all information required by legislation and is formally submitted to all lot owners for consideration.
What happens if some lot owners do not support the Strata Renewal Plan?
If at least 75% of lot owners support the plan but some owners dissent, the owners corporation must apply to the NSW Land and Environment Court for orders approving the plan. The Court may then make orders compelling dissenting owners to comply with the approved renewal process.
Can a single lot owner stop a strata renewal collective sale or redevelopment?
No. Under the Part 10 strata renewal process, a single lot owner cannot prevent a collective sale or redevelopment if at least 75% of lot owners have approved the Strata Renewal Plan.
What is a collective sale in the context of strata law?
A collective sale is one of the two possible outcomes of the strata renewal process under Part 10. It involves the sale of 100% of the lots and common property within a strata scheme, typically to a developer or single purchaser, with the approval of at least 75% of lot owners.
Do strata schemes registered before November 2016 need to do anything special for strata renewal?
Yes. Strata schemes registered before 30 November 2016 must first pass a general resolution by simple majority to formally opt in to the Part 10 strata renewal provisions before commencing a renewal proposal.
Who typically prepares the Strata Renewal Plan?
The Strata Renewal Plan is prepared by a Strata Renewal Committee elected by the owners corporation after initial approval of the renewal proposal at a general meeting. The committee is responsible for managing and developing the detailed plan for collective sale or redevelopment.
