What is Estate Planning?
Estate planning is the holistic process of structuring how your assets will be managed and protected both during your lifetime (if you become unable to make decisions) and after your death.
What’s the difference between a Will and an Estate Plan?
A Will is a single document that outlines how your assets are distributed after you die. An Estate Plan is a comprehensive strategy that includes your Will, but also crucial documents like Powers of Attorney and Enduring Guardianships for managing your affairs while you’re still alive.
What does a typical Estate Plan include?
A standard Estate Plan includes a Will, an Enduring Power of Attorney (for financial decisions), and an Appointment of Enduring Guardian (for health and lifestyle decisions). It can also include more complex structures like Testamentary Trusts.
Why is an Enduring Power of Attorney important?
An Enduring Power of Attorney allows a person you trust to manage your financial and legal affairs on your behalf if you lose the mental capacity to do so yourself. It provides crucial protection while you are alive.
What is an Appointment of Enduring Guardian?
This legal document authorises a person you appoint to make lifestyle and healthcare decisions for you, such as where you live and what medical treatment you receive, if you become unable to make those decisions.
What is a Testamentary Trust?
A Testamentary Trust is a trust created within your Will that comes into effect after your death. It can provide significant asset protection for your beneficiaries against claims from creditors or relationship breakdowns, and may offer tax benefits.
When should I create or review my Estate Plan?
You should review your Estate Plan after any major life event, such as a marriage, divorce, the birth of a child, a significant change in financial circumstances, or if a nominated Executor or Guardian can no longer act.
Are jointly owned assets covered by my Will?
Not always. Assets owned as ‘joint tenants’ (like a family home) automatically pass to the surviving owner and are not controlled by your Will. A lawyer can advise on how to structure ownership to match your intentions.
