Comprehensive Planning for Your Lifetime & Beyond

Effective estate planning is a holistic strategy that goes far beyond simply writing a Will. It safeguards your interests and protects your loved ones by creating a clear plan for how your financial and personal affairs are managed if you lose the capacity to make decisions yourself, and how your assets are distributed after you pass away.

A well-structured plan ensures your assets are protected, potential tax is minimised, and the risk of family disputes is reduced. At PBL Law Group, our experienced lawyers help you create a comprehensive plan that provides security for you and clarity for your family, securing your legacy with diligence and care.

The Essential Documents of Your Estate Plan

A complete estate plan is typically built upon three essential legal documents: a Will, an Enduring Power of Attorney, and an Appointment of Enduring Guardian. While your Will directs your assets after death, the Power of Attorney and Guardianship appoint trusted people to manage your financial and healthcare decisions respectively, if you can no longer do so.

Together, these documents create a complete framework that ensures your wishes are respected in any circumstance. This proactive planning prevents your family from facing the stress and expense of applying to a court or tribunal to make decisions on your behalf. PBL Law Group specialises in drafting these interconnected documents to provide a seamless and robust plan for your future.

NSW Estate Planning FAQs

Estate planning is the holistic process of structuring how your assets will be managed and protected both during your lifetime (if you become unable to make decisions) and after your death.

A Will is a single document that outlines how your assets are distributed after you die. An Estate Plan is a comprehensive strategy that includes your Will, but also crucial documents like Powers of Attorney and Enduring Guardianships for managing your affairs while you’re still alive.

A standard Estate Plan includes a Will, an Enduring Power of Attorney (for financial decisions), and an Appointment of Enduring Guardian (for health and lifestyle decisions). It can also include more complex structures like Testamentary Trusts.

An Enduring Power of Attorney allows a person you trust to manage your financial and legal affairs on your behalf if you lose the mental capacity to do so yourself. It provides crucial protection while you are alive.

This legal document authorises a person you appoint to make lifestyle and healthcare decisions for you, such as where you live and what medical treatment you receive, if you become unable to make those decisions.

A Testamentary Trust is a trust created within your Will that comes into effect after your death. It can provide significant asset protection for your beneficiaries against claims from creditors or relationship breakdowns, and may offer tax benefits.

You should review your Estate Plan after any major life event, such as a marriage, divorce, the birth of a child, a significant change in financial circumstances, or if a nominated Executor or Guardian can no longer act.

Not always. Assets owned as ‘joint tenants’ (like a family home) automatically pass to the surviving owner and are not controlled by your Will. A lawyer can advise on how to structure ownership to match your intentions.

An experienced lawyer ensures all documents are legally valid, identifies potential risks you may not have considered, and provides strategic advice on asset protection and tax implications. This holistic approach prevents costly disputes for your family later on.
